  • Follow privacy and data protection laws in how you use the introductions and information we provide.

  • We work hard to deliver qualified introductions, but we can’t guarantee that every introduction leads to a client or a placement.

Welcome to The Elka Method. These Terms of Service (“Terms”) are an agreement between you and The Elka Method LLC, a New Mexico limited liability company (“Company,” “we,” “our,” or “us”). By accessing or using our website (elkamethodagency.com) or our services, you agree to these Terms. Please read them carefully.

1. Services Provided

The Elka Method provides a done-for-you, AI-powered client acquisition service for recruitment agencies. The service includes identifying companies that are actively hiring, locating the hiring decision-maker at those companies, creating personalized outreach on the client’s behalf, managing follow-ups, and introducing interested decision-makers to the client.

2. Definitions

“Qualified Introduction” means a direct introduction to a hiring decision-maker at a company actively hiring for the roles the client recruits, made after that decision-maker has responded with interest.

“Client” means a business that engages us to provide our services under a written or electronic agreement, proposal, or order.

3. Eligibility

You must be at least 18 years old and legally authorized to represent a business in order to engage our services.

4. Client Responsibilities

Clients agree to:

  • Provide accurate and complete information during onboarding.
  • Use our services only for lawful purposes and in compliance with applicable laws, including data protection and email laws such as GDPR, UK GDPR, CCPA, and CAN-SPAM.
  • Maintain the confidentiality of any login credentials.
  • Not resell, redistribute, or misuse service outputs without our permission.

    5. Payment & Refunds

    • Clients agree to pay fees as outlined in their agreement with us.

    • Clients pay only for Qualified Introductions we deliver. If we do not deliver a Qualified Introduction, no fee is owed for it.

    • Fees for delivered Qualified Introductions are non-refundable, except where our agreement with the client expressly says otherwise.

    • Late payments may result in suspension or termination of services.

    6. Data Usage & Privacy

    By using our services, you acknowledge and agree to our Privacy Policy. We may process personal data of third parties (e.g., decision-makers) on behalf of clients, strictly for recruitment outreach purposes.

    7. Intellectual Property

    All software, systems, workflows, and content created by The Elka Method LLC remain our intellectual property. Clients receive a limited, non-exclusive, non-transferable license to use service outputs for their own business purposes.

    8. Prohibited Uses

    You must not use our services and website to:

    • Engage in unlawful, defamatory, or fraudulent activities.

    • Harass, spam, or mislead decision-makers.

    • Violate data protection laws or third-party rights.

    9. Disclaimers

    • Our services and website are provided “as is” and “as available.”

    • We do not guarantee that outreach will produce any particular number of responses, introductions, clients, or placements, except as expressly stated in the client’s agreement.

    • We do not warrant uninterrupted or error-free operation.

    10. Limitation of Liability

    To the maximum extent permitted by law:

    • We are not liable for indirect, incidental, special, or consequential damages.

    • Our total liability for any claim related to our services will not exceed the fees paid by the client in the three (3) months before the claim arose.

    11. Indemnification

    Clients agree to indemnify and hold harmless The Elka Method LLC, its members, affiliates, and personnel from claims, damages, and liabilities arising out of the client’s misuse of our services or breach of these Terms.

    12. Termination

    We may suspend or terminate access to our services if you breach these Terms. Clients may end the services in accordance with their agreement with us.

    13. Governing Law & Jurisdiction

    These Terms are governed by the laws of the State of New Mexico, U.S.A., without regard to conflict-of-law rules. Any dispute arising from these Terms will be resolved in the state or federal courts located in New Mexico.

    14. General

    • Entire agreement. These Terms, together with the client’s agreement, proposal, or order and our Privacy Policy, are the entire agreement between you and us about the services. If they conflict, the client’s signed agreement, proposal, or order controls.
    • Severability. If any part of these Terms is found unenforceable, the rest remains in effect.
    • No waiver. Our failure to enforce a provision is not a waiver of it.
    • Website visitors. If you only visit our website and are not a Client, sections 7, 8, 9, 10, and 13 still apply to your use of the site.

    15. Changes to Terms

    We may update these Terms from time to time. The “Effective Date” at the top shows when they were last changed. Continued use of our website or services after an update means you accept the updated Terms.
